Mr. Smith has years of experience representing employers in such issues as employment discrimination, sexual harassment, ADA compliance, ADEA, retaliation, occupational safety and health, wage and hour violations, workers' compensation and wrongful termination litigation. Mr. Smith has also advised employers regarding such matters as discipline, termination, wage and hour compliance, drug and alcohol testing, employee disabilities, background investigations, workplace investigations, contract drafting and administration, protection of trade secrets and confidential information, employment agreements, and personnel policies.
Employment laws are extremely tricky and the rules are constantly changing. Did you know there are more than 90 statutes, rules, and regulations in Nevada which restrict your ability to discharge an employee even in a "right to work" state like Nevada? Don't be shocked, be forewarned. Two dozen rules are based on Nevada statutes, several are based on Nevada cases, and the rest are based on federal laws.
"I had the pleasure of working closely on a complex labor dispute with multiple vulnerability points for over 14 months brought upon us by a disgruntled employee. I found Kirby to be one of the most knowledgeable attorneys I have ever met and beyond that, Kirby had a genuine passion for ensuring that he advised us to the very best of his ability. His wise counsel and profound understanding of all matters of law related to our defending ourselves against a vicious attack on a variety of fronts, guided us through a very challenging ordeal. In the end we came out completely exonerated of all alleged wrong doing and prevailed on no less than 7 separate claims filed against us in City, County, State and Federal jurisdictions. I cannot imagine what the outcome of this ordeal might have been without the skills and dedication of Kirby Smith. His services were exemplary and his advice and counsel was always spot on, well thought out and extremely valuable to us. I would recommend the services of Kirby Smith, Esq. to anyone without reservation. In the event I am ever in need of an Attorney for any reason in the future, Mr. Smith is the only one I would call." --C. F., Business Administrator

TWO REPRESENTATIVE CASES
(1) Jennifer Munyon v. Christ Lutheran Church
EEOC, Labor Commissioner, NOSH.
Opposing Counsel: Kristina Holman, Esq.
We represented the Defendant Church responding to a grueling series of formal and informal complaints made to City, County, State and Federal authorities alleging employment discrimination, retaliation, wage and hour violations, unsafe working conditions, embezzlement, and more. It is no exaggeration to say the Church's survival was at risk. All thrusts were successfully parried and all matters were defended to the great relief of the client.
(2) Joseph Valdez v. Cox Communications, et al.
Hon. Philip M. Pro, presiding judge.
Opposing Counsel: Leon Greenberg, Esq.; Christian James Gabroy, Esq. Other counsel: Rick Roskelley, Esq.; Howard Cole, Esq., Dominica Anderson, Esq., others.
We represented one of the defendants in a FLSA class and collective action. We repeatedly battled with plaintiffs' counsel over numerous issues, sometimes repeatedly over the same issue, in contentious motion practice until the case was positioned favorably for a minimal settlement. Overall, the docket for this case totaled almost 500 entries.
